Blue Mountain Live it Outside Contest Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING.

1. SPONSOR
The “Live It Outside Contest” (the “Contest”) is sponsored by Blue Mountain Resorts LP (“Sponsor”) and the address at which the Sponsor may be contacted is Blue Mountain Resorts LP, 190 Gord Canning Drive, Blue Mountains, Ontario L9Y 3Z2.

2. TIMING
The Contest entry period begins on October 26, 2017 at 9:00 am Eastern Time (“ET”) and ends October 29, 2017 at 10:00 pm ET (the “Entry Period”). Sponsor’s or its designee’s computer is the official timekeeping device for the Contest.

3. AGREEMENT TO OFFICIAL RULES AND DECISIONS
By participating in the Contest, each entrant fully and unconditionally agrees to be bound by these Official Rules (the “Rules”) and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winners, and the awarding of the prize), which are final and binding in all respects.

4. ELIGIBILITY
The Contest is open to legal residents of Canada, excluding residents of Quebec and where prohibited or restricted by law, who have reached the age of majority in the province in which they reside. Employees, officers and directors of Sponsor, and their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the immediate families (defined as parents, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter.

5. HOW TO ENTER
There are three (3) ways to register for a Main Entry (defined below) into the Contest and one (1) way to register for up to fifty (50) Bonus Entries into the Contest.

a) To register for a Main Entry into the Contest:
(i) Attend the Toronto Ski & Snowboard Show during the Entry Period and complete and submit a Live It Outside survey (“Survey”);
(ii) Enter the Contest online by visiting www.bluemountain.ca/liveitoutsidecontest (the “Contest Website”) during the Entry Period and complete and submit a Survey; or
(iii) Enter the Contest by sending a unique and original handwritten 150-word essay, in either English or French, on “Why you love Blue Mountain” (“Essay”).


b) If completing a Survey, you will be required to: (i) complete and submit the Survey; (ii) provide your first and last name, age, email address and social media handle and (iii) read and agree to be legally bound by the terms and conditions of these Rules. Once you have fully completed and submitted the Survey, you will be registered for one (1) main entry (“Main Entry”) into the Contest. You may only complete and submit one (1) Survey and any person found submitting more than one (1) Survey will be disqualified.

c) If submitting an Essay, you will be required to: (i) submit the Essay and (ii) provide your first and last name, age, email address, mailing address and day/evening phone number in an envelope with sufficient postage to Blue Mountain Resorts Limited Partnership, 108 Jozo Weider Blvd., Blue Mountains, Ontario Canada L9Y 3Z2 – Blue Mountain Live It Outside contest (collectively, a “Mail-in Request”). Each Mail-in Request must be post-marked during the Entry Period and must be received by no later than October 30, 2017. One (1) Mail-in Request per envelope. Once your Mail-in-Request is received, you will be registered for one (1) Main Entry into the Contest. Each Essay may only be submitted once and any person found submitting the same Essay more than once will be disqualified.

d) To obtain Bonus Entries, regardless of which method used to register for a Main Entry, you may submit an Essay which will register you for a bonus entry (“Bonus Entry”) into the Contest. If you have already registered for a Main Entry by submitting an Essay, any Essay(s) submitted to register for a Bonus Entry(ies) must be different from the Essay submitted for your Main Entry. You may earn a maximum of fifty (50) Bonus Entries by submitting up to fifty (50) unique, original Essays. Main Entries and Bonus Entries may be individually referred to herein as an “entry” and collectively referred to as the “entries”.

6. FOR ALL ENTRIES
You must complete and submit all required information pursuant to your chosen method of entry to be eligible to enter to win the Prize. All entries must be received by Sponsor or its designee during the Entry Period. Sponsor is not responsible for lost, late, incomplete, invalid, void, unintelligible, or misdirected entries, which will be disqualified. In the event of a dispute as to an entrant’s entry, the natural person who is the authorized account holder of the email address used to enter will be deemed to be the entrant, but only if that person is otherwise eligible to enter the Contest. The “authorized account holder” is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be required to show proof of being the authorized account holder. If a dispute cannot be resolved to Sponsor’s satisfaction, the winning entrant may be deemed ineligible. All entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of submission will not be deemed proof of receipt of entry by Sponsor. All entrants and entries are subject to verification prior to the awarding of a prize, as are the eligibility, age and other claims of/information provided by a potential prize winner.Entrants will cooperate with Sponsor and its representatives in connection with any and all verification activities, including, without limitation, by executing and delivering to Sponsor or its designee by the time indicated by Sponsor or its designee any verification forms required by Sponsor or its designee.

7. PRIZE
Subject to the terms and conditions of these Official Rules, one (1) prize will be awarded in this Contest. The prize consists of and is limited to a two (2)-night stay in a Village 1 bedroom suite for up to four (4) people; one (1) two-hundred-dollar ($200.00) Blue Mountain Resort gift card; and up to four (4) day/night lift tickets per day (for a total of eight (8) day/night lift tickets) (the “Prize”). AIRFARE IS NOT INCLUDED IN THE PRIZE. The aggregate approximate retail value (“ARV”) of the prize to be awarded in the Contest is $1,800 CAD. Redemption is subject to availability and the following blackout dates will apply: December 23, 2017 – January 1, 2018; February 16 – 19, 2018. Trip must be completed by April 30, 2018. Winner will be notified of how to redeem prize and will be responsible for booking airfare and accommodations prior to and following the trip. Arrangements are all subject to space availability. Once confirmed, accommodation arrangements cannot be changed. The winner will be responsible for all costs, expenses and incidentals that are not specifically stated as being included in the prize, including but not limited to, airfare, accommodations before and following the trip, personal items, food, alcohol purchases, massages, Blue Mountain shop purchases, gratuities, taxes, and insurance. The winner is responsible for ensuring that he/she has any and all required travel documentation and identification, including passports and visas as applicable, and to ensure that such travel documentation or identification is valid prior to and for the entire duration of travel, and to comply with any customs and immigration requirements. It is recommended that the winner obtain sufficient personal travel insurance prior to departure. If the winner decides not to travel, no credit or reimbursement will be awarded. Sponsor will not replace lost or stolen travel documents. If the winner is not able to complete the trip by April 30, 2018, the prize will be forfeited and no alternative prize will be awarded. Prize is nontransferable, nonassignable, nonnegotiable, and not redeemable for cash or credit, except as otherwise provided in these Official Rules. Prize must be accepted as awarded. To the fullest extent permitted by applicable law, prize is awarded “AS IS” with no warranty, condition, representation, or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No prize substitutions, except by Sponsor, who reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize of comparable or greater value (including cash) if the prize (or a component thereof) is not available for any reason as determined by Sponsor in its sole discretion. Unused components of the prize shall be forfeited and have no redeemable cash value. Winner is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize award, redemption, receipt and use not specified in the prize description above, including, without limitation, all international, federal, provincial and local taxes on the prize. Winners waive the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem the prize. Non-compliance with any of the foregoing and any other condition of this Contest may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded.

8. DRAWING; ODDS, NOTIFICATION
a) There is one (1) prize drawing in the Contest (the “Prize Drawing”). All eligible entries in the Contest received by Sponsor or its designee for the entire Entry Period will constitute the pool of entries for the Prize Drawing. On or about October 30, 2017 at Sponsor’s offices located in Blue Mountains, Ontario, Sponsor will randomly select one (1) potential winner from among all eligible entries received by Sponsor during the Entry Period and the potential winner will be announced at approximately the same time.

b) Odds of winning the Prize will depend on the number of eligible Entries received by Sponsor or its designee in the Contest and the number of eligible entries submitted by entrant. The potential winner will be notified by phone and/or email. The potential winner selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements set forth herein. The potential winner will be required to execute and return to Sponsor a Declaration of Eligibility, a Liability Release, and, except where prohibited by law, a Publicity Release (a “Declaration and Release”) in the form(s) provided by Sponsor in order to claim his/her prize. The Declaration and Release must be returned to Sponsor by the date and/or time indicated within the Declaration and Release. The potential winner will also first be required to correctly answer, without assistance of any kind whatsoever mechanical or otherwise, a mathematical skill-testing question in no more than five (5) minutes, the test to be administered by telephone, in order to be eligible to win the prize. If a potential winner cannot be contacted within seventy-two (72) hours of the first attempt to contact him/her, or if a potential winner who is a Canadian resident fails to correctly answer the skill testing question in the manner prescribed, or if a potential winner fails to return the Declaration and Release with the specified time, or if any prize or prize notification is returned as undeliverable, or if a potential winner is found to be ineligible by Sponsor in its sole discretion, or if a potential winner does not comply with the Official Rules, then the potential winner may be disqualified and an alternate potential winner selected by Sponsor in the Contest. In such event, an alternate potential prize winner will be notified as described above and will be required to return the required documents to Sponsor as described above; provided, however, Sponsor may alter the above timing to meet its Contest schedule.

9. PUBLICITY
Except where prohibited by law, participation in the Contest constitutes winner’s consent to Sponsor’s (and its designees’, successors’ and assigns’) use of winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, province and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, attribution, notice, review or consent.

10. GENERAL CONDITIONS
Sponsor reserves the right to require Entrants to complete, execute and deliver to Sponsor additional documents at any time as required, in the forms provided, and within the timeframe required by Sponsor, or the Entrant and participants may be disqualified. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Contest if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. In such event, Sponsor reserves the right (but does not have the obligation) in its sole discretion to award Prizes at random. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.

11. RELEASE
By entering, each Entrant forever and irrevocably releases and holds harmless Sponsor, Intrawest ULC, and each of their parents, subsidiaries and affiliates, and their respective agents, advertising and promotion agencies, affiliates, and Contest partners and prize suppliers, and all of their respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from Entrant’s participation and/or entry in the Contest and/or Entrant’s award, receipt or use of any prize awarded in the Contest.

12. LIMITATION OF LIABILITY
Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, inaccurate incomplete, undelivered or misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Contest; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Contest or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to Entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest, or from viewing, playing or downloading any material from Sponsor’s website(s) or the Application, regardless of whether the material was prepared by Sponsor or a third party, and regardless of whether the material is connected to Sponsor’s websites by a hypertext link.

13. DATA COLLECTION
Entrants provide personal information to Sponsor and its designees when they enter the Contest. Sponsor and its designees collect this information and use it to administer this Contest and for market research and other marketing purposes.When you enter the Contest, you will be given an opportunity to consent to receive marketing and promotional communications from Sponsor and/or its affiliates. Consenting to receive such emails and information is optional, and is not necessary to enter or win this Contest, nor will it increase or improve your chances of winning.Sponsor may share your personal information with third parties who need access to this information to perform services on Sponsor’s behalf. 14. DISPUTES
Each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in the Province of Ontario; entrant submits to sole and exclusive personal jurisdiction to said courts in the Province of Ontario for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Province of Ontario and the Federal laws of Canada, without giving effect to any choice of law or conflict of law rules or provisions, which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
